Terms of Service

1. Agreement to these Terms

These Terms of Service (“Terms”) form a legal agreement between you and Liew Kian Yang (“we”, “us”) governing your use of the AppFreeGame website at https://appfreegame.games (the “Site”) and the games and features available on it (collectively, the “Service”).

By accessing or using the Service you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

The Service provides browser-based games that, once loaded, can be played offline in the same browser session. Optional features include a user account, a public leaderboard, and personal best tracking. The Service is provided free of charge.

We may add, change, or remove games and features at any time. The Service may be unavailable from time to time for maintenance or reasons outside our control.

3. Eligibility

You must be at least 13 years old (or 16 if you live in the European Economic Area or the United Kingdom) to create an account or use the Service. By creating an account you represent that you meet this age requirement.

4. User accounts

You may use most of the Service without an account, but to have your scores recorded on the public leaderboard you need to register. When you register you agree to:

  • Provide accurate information (a valid email address and a nickname).
  • Keep your password confidential and not share your account.
  • Notify us promptly if you suspect unauthorised access to your account.
  • Be responsible for all activity that takes place under your account.

We may refuse, suspend, or terminate accounts at our discretion if we believe these Terms have been violated, particularly Section 5 (Acceptable Use).

5. Acceptable use

You agree NOT to:

  • Use any automation, bot, script, modified client, or other tool to generate, submit, or inflate scores. Submissions detected as non-human will be rejected and may result in account termination.
  • Attempt to gain unauthorised access to other accounts, the Service, or any related system or network.
  • Reverse-engineer, decompile, or disassemble the Service, except to the extent expressly permitted by applicable law.
  • Copy, mirror, frame, scrape, or redistribute the Service or any substantial portion of it on any other website, service, or distribution channel without our prior written consent.
  • Scrape, crawl, harvest, or otherwise extract content, source code, or user-generated data from the Service for the purpose of training, fine-tuning, or evaluating any artificial intelligence model, machine learning system, or large language model, in whole or in part. This restriction applies whether the model is commercial, academic, open source, or for personal use.
  • Disrupt or place an unreasonable load on our infrastructure (e.g. DoS attempts, excessive automated requests).
  • Use a nickname that is unlawful, defamatory, harassing, hateful, obscene, or that impersonates another person.
  • Use the Service for any illegal purpose or in violation of any applicable law, including the laws of Malaysia.

6. Intellectual property

The Service, including all source code, game logic, design, text, images, sounds, trademarks, and other content, is owned by us or our licensors and is protected by copyright, trademark, and other laws. See our LICENSE for the specific terms under which the source code is made available.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non- commercial enjoyment. No other rights are granted. All rights not expressly granted are reserved.

7. User content

The only content you submit to us is your nickname, scores, and game-completion timestamps. By submitting them you grant us a worldwide, royalty-free licence to display them publicly on the leaderboard and to retain them as part of our records, subject to our Privacy Policy.

You retain ownership of your nickname; we may, however, change or remove a nickname that violates Section 5.

8. Advertising

The Service is supported by advertising provided by third parties, including Google AdSense. By using the Service you agree to the display of advertising. See our Privacy Policy (Section 4) for details on advertising cookies and how to opt out of personalised advertising.

9. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and the absence of bugs or interruption. We do not warrant that the Service will meet your requirements, be uninterrupted, secure, or error-free, or that defects will be corrected.

10. Limitation of liability

To the maximum extent permitted by law, in no event will we, our affiliates, or our suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising from or in connection with your use of, or inability to use, the Service. Our total aggregate liability to you for any and all claims arising out of or relating to these Terms or the Service shall not exceed USD 100, or, if applicable, the amount you have paid us in the twelve months preceding the claim, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above may not apply to you in full.

11. Indemnification

You agree to defend, indemnify, and hold harmless us and our affiliates from and against any claims, damages, losses, or costs (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your infringement of any third-party right.

12. Termination

You may stop using the Service or delete your account at any time by contacting [email protected]. We may suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms or applicable law, or if we discontinue the Service.

Sections that by their nature should survive termination (Sections 6, 9, 10, 11, 14) will continue to apply.

13. Modifications

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when the current version took effect. If the changes are material we will notify registered users by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing law and dispute resolution

These Terms are governed by the laws of Malaysia, without regard to its conflict of laws principles. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia, unless mandatory consumer protection law in your country of residence requires otherwise.

15. Miscellaneous

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our prior written consent. These Terms, together with the Privacy Policy and the LICENSE, constitute the entire agreement between you and us regarding the Service.
